The Regional Sponsored Migration Scheme (RSMS) is for employers in regional Australia to fill skilled positions they are unable to fill from the local labour market.
Under the RSMS, employers are able to nominate staff from overseas or temporary residents currently in Australia to fill full-time, permanent vacancies. The employees applying for this visa can be either skilled workers from overseas or skilled temporary residents. This visa allows you and any dependent family members included in your visa application to live as permanent residents in Australia.
An eligible position must meet the following requirements:
- is located in a regional area
- cannot be filled by an Australian employee
- is a genuine full-time vacancy
- is available for at least 2 consecutive years
- requires a person with qualifications equivalent to at least Australian diploma level (unless exceptional circumstances apply).
To be eligible for a permanent visa under the Regional Sponsored Migration Scheme, the prospective employee must:
- ave the relevant qualifications for the nominated position, which are equivalent to at least an Australian diploma level
- meet any mandatory licensing, registration or professional membership requirements
- have been offered a position for a fixed term of at least 2 years (supported by evidence of a contract or letter of appointment signed by both the employer and the employee)
- be under 45 years
- have Functional English language ability
This visa allows you to migrate to Australia if you have good English language skills and have skills and qualifications in an occupation in need in Australia. You do not require sponsorship to apply for this visa subclass.
This visa uses a points test to select visa applicants with characteristics needed in the Australian labour market. The points test pass mark for this visa is 120 points. If you score less than 120 points but more than 100 points your application will be placed in reserve (the 'pool') and will remain in the pool for two (2) years after assessment. If the pass mark is lowered at any time during the two (2) year period, and your score is equal to or higher than the new pass mark, your application will then be processed further. If you score less than 100 points, your application will be refused.
Applicants must also:
- be under 45 years of age;
- nominate an occupation listed on the Skilled Occupation List (SOL);
- have a competent level of English or vocational level of English if their nominated occupation is a trade;
- have a positive skills assessment for their nominated occupation from a relevant assessing authority, and been employed for 12 out of the last 24 months in an occupation listed on the SOL;
- or met the two year study requirement in the last six months with qualifications closely related to the nominated occupation.
If you are a temporary resident in Australia, and have a proven ownership interest in one or more successful businesses in Australia, you can apply for permanent migration under the Regional Established Business in Australia (Subclass 846 visa) category. You must be sponsored by a state/territory government authority.
If you hold a Business (long stay) visa (Subclass 457), and have owned a business in a designated regional area of Australia for at least two years, you may be able to apply for this visa.
There are main requirements you must meet to be eligible for a Regional Established Business Visa in Australia visa. You must provide evidence of each of the requirements with your application.
- You hold a Business (Long Stay) visa (subclass 457).
- You have been sponsored by the relevant State/Territory government authority.
- You have been in Australia as a temporary resident for at least 12 months cumulatively out of the last 24 months before the date of application.
- You have held an ownership interest of at least 10% in up to two main businesses in a designated area of Australia for at least two years immediately before applying and continue to have an interest of that kind or your main business (or two main businesses) have had a turnover of at least A$200,000 or your main business has total exports of at least A$100,000; in each of the two years immediately before you apply.
- Your (or your and your spouse's) total net assets in Australia were at least A$200,000 for the two years before you apply.
- Your (or your and your spouse's) net assets in your main business (or two main businesses) in a designated area of Australia were no less than A$75,000 in the 24 months before you apply.
- You have been actively involved in, and directly responsible for, the day to day management and overall performance of your main business (or two main businesses) for the 24 months before you apply.
- You have an overall successful business career.
- You have not been involved in business or investment activities considered unacceptable in Australia.
- You must score at least 105 points in the regional established business in Australia points test (unless there are exceptional circumstances).
- The department will work out your points score from the information you give in your application.
- To complete your own preliminary points test.
- You must meet certain health requirements and may need to undergo a health examination.
- You must be of good character for you to enter Australia.
The main requirements for this visa are:
- You must meet to be eligible for a Established Business in Australia visa. You must provide evidence of each of the requirements with your application.
- You are the holder of a visitor visa, student visa or temporary resident visa, which is not a special purpose visa, border visa, diplomatic visa, domestic worker visa or transit visa.
- You have an overall successful business career.
- You have been in Australia for at least nine months cumulatively in the 12 months before you apply.
- You have held an ownership interest of at least 10% in up to two main businesses in Australia for at least 18 months immediately before you apply.
- Your (or your and your spouse's) total assets in Australia for the 12 months prior to applying were greater than A$250,000.
- Your (or your and your spouse's) total net assets in your main business (or two main businesses) in Australia for the 12 months prior to application were greater than A$100,000.
- You have been actively involved in, and directly responsible for, the day to day management and overall performance of your main business (or two main businesses).
- You (or your spouse) have never been involved in unacceptable business activities in Australia.
- You must score at least 105 points in the established business in Australia points tests (the department will work out your points score from the information you give in your application). You can complete a preliminary assessment of your points score.
This visa provides for the temporary stay of persons who will be full-time religious workers in Australia. Religious work is work of a religious nature for which the applicant has had relevant religious training. The religious work proposed must directly serve an organisation's religious objectives. It would usually be religious work involved in:
- providing spiritual leadership
- conducting worship
- teaching or guidance in religion
- ministering, pastoral care or proselytising
- other high level specialist work in relation to the above.
This visa is for Religious workers from overseas who wish to work in Australia to directly service an organisation's religious objectives. You must be sponsored by a religious organisation in Australia for this visa. The religious organisation must meet the requirements to gain sponsorship, and the religious worker must meet the requirements to be granted this visa.
This visa is not intended for people who wish simply to undertake work for a religious organisation. It must be for work that specifically requires a religious worker and not merely a religious adherent.
The purpose of this visa is to allow holders of certain provisional visas to apply for permanent residency.
To be granted this visa, you must have lived for at least two (2) years and worked full time for a total period of 12 months in a Specified Regional Area of Australia.
This visa is for you if you hold one of these visas:
- Skilled – Independent Regional (Provisional) visa (subclass 495)
- Skilled – Designated Area – Sponsored (Provisional) visa (subclass 496)
- Skilled – Regional Sponsored (Provisional) visa (subclass 475)
- Skilled – Regional Sponsored (Provisional) visa (subclass 487)
and you:
- have lived in a Specified Regional Area for at least two (2) years
- have worked full time in a Specified Regional Area for at least one (1) year
- have complied with the conditions on your visa.
This visa does not have a points test but there are other strict eligibility requirements that must be met before applying for this visa.
This visa allows you to migrate to Australia if you have good English language skills and have skills and qualifications in an occupation in need in Australia.
This visa uses a points test to select visa applicants with characteristics needed in the Australian labour market. The points test pass mark for this visa is 100 points. If you score less than 80 points, your application will be refused. If you score at least 80 points but less than 100 points your application will be placed in a reserve pool.
You must be sponsored by an eligible relative living in Australia or obtain nomination from a participating State or Territory government agency. This visa is for you if you are under 45 years of age or have the skills and qualifications that meet the Australian standard for an occupation on the Skilled Occupation List (SOL). The SOL is a list of skilled occupations that are in need in Australia. Each occupation listed on the SOL is allocated a points value for use in the visa assessment process.
Note: All State and Territory governments in Australia are participating in this visa scheme.
Skilled – Regional Sponsored (Provisional) visa (subclass 475) This visa is a three year provisional visa for skilled workers who are unable to meet the criteria for a Skilled - Independent visa. You will have the opportunity to apply for permanent residency after you have lived for two years and worked at least 12 months in a Specified Regional Area of Australia.
This visa requires you to be either:
- nominated by a participating State or Territory government agency or
- sponsored by an eligible relative living in a designated area of Australia.
This visa uses a points test to select visa applicants with characteristics needed in the Australian labour market. The points test pass mark for this visa is 100 points. If you score less than 100 points, your application will be refused.
This visa is for you if you are outside Australia or a New Zealand citizen who holds a Special Category visa (subclass 444).
You must:
- be under 45 years of age
- have good English language skills
- have the skills and qualifications that meet the Australian standard for an occupation on the Skilled Occupation List (SOL)
The SOL is a list of skilled occupations that are in need in Australia. Each occupation listed on the SOL is allocated a points value for use in the visa assessment process.
You must meet all of the basic eligibility requirements and pass the points test.
This visa allows overseas students who have completed their course studies in Australia and holders of certain temporary visas to apply for permanent residency.
This visa uses a points test to select visa applicants with characteristics needed in the Australian labour market. You do not require sponsorship to apply for this visa.
This visa is for you if you are in Australia and you are one of the following:
- an overseas student or former overseas student
- a holder of a Skilled – Graduate (subclass 485) visa or Skilled – Recognised Graduate (subclass 476) visa
- a holder of a Trade Skills Training (subclass 471) visa.
You must:
- be under 45 years of age (the potential point value decreases according to the age of the applicant)
- have good English language skills
- have the skills and qualifications that meet the Australian standard for an occupation on the Skilled Occupation List (SOL) and your nominated occupation is classified as either a 60 point occupation or a 50 point occupation.
The SOL is a list of skilled occupations that are in need in Australia. Each occupation listed on the SOL is allocated a points value for use in the visa assessment process.
